Calcutta High Court Orders Preservation of Bhowanipore Election Petition Records and EVMs

The Calcutta High Court has issued a significant directive concerning the Bhowanipore constituency election petition. Justice Gaurang Kanth has mandated the preservation of all EVMs (Electronic Voting Machines), VVPATs (Voter Verifiable Paper Audit Trails), and associated CCTV footage from the vote counting process held on May 4. This legal move follows an election petition filed by Trinamul Congress leader Mamata Banerjee, who is challenging her electoral defeat at the hands of BJP candidate Suvendu Adhikari.

Court Oversight on Election Records

In his order, Justice Gaurang Kanth explicitly prohibited the alteration or destruction of any records related to the counting procedures without prior judicial authorization. The court has scheduled the subsequent hearing for this matter in two months. Before proceeding with the case, the judge proactively disclosed that his brother serves as a BJP spokesperson. He invited both legal teams to express any concerns regarding potential conflicts of interest, but both parties, including Mamata Banerjee's counsel, Kalyan Banerjee, affirmed their continued confidence in the judge presiding over the case.

The core of the dispute involves allegations regarding the integrity of the vote-counting process. During the proceedings, Kalyan Banerjee argued that there was a highly unusual shift in the voting pattern. According to his presentation, this change became notably apparent starting from the 13th round of counting, occurring shortly after agents representing Suvendu Adhikari visited the counting facility located at Shakhawat Memorial School.

The petition highlights that Mamata Banerjee had maintained a lead of nearly 7,000 votes following the completion of the 12th round. The legal team representing the former West Bengal Chief Minister intends to utilize analytical charts to demonstrate how the final results were allegedly manipulated. The request for preserving all electoral data is seen as a critical step in facilitating an objective review of these claims.
